House Rules
1. USE OF THE PROPERTY
1.1. The Guest agrees to use the property solely for residential vacation purposes.
1.2. No more than 6 guests may occupy the house at any time.
1.3. No pets are allowed on the premises.
1.4. Smoking is strictly prohibited indoors; designated smoking areas are provided outside.
2. LIABILITY & INDEMNIFICATION
2.1. The Guest acknowledges that Marloth Park is a wildlife conservancy where animals roam freely. The Owner shall not be liable for any injuries, damages, or losses arising from interactions with wildlife.
2.2. The Guest assumes full responsibility for their personal safety and the safety of any minors accompanying them.
2.3. The Owner shall not be liable for loss or damage to the Guest’s personal belongings.
3. DAMAGE & RESPONSIBILITY
3.1. The Guest is responsible for any damage caused to the property, furniture, appliances, or fixtures during their stay.
3.2. The cost of repairs or replacements will be deducted from the security deposit or charged separately if necessary.
4. HOUSE RULES (a comprehensive copy of Marloth Park Rules are available in the kitchen)
4.1. Guests must respect the peace and quiet of the area, with no excessive noise after 22:00.
4.2. Fires may only be made in the designated boma area and must be fully extinguished before leaving the area unattended.
4.3. Waste must be disposed of properly (in the designated waste bins) to avoid
attracting wildlife.
5. FORCE MAJEURE & SERVICE INTERRUPTIONS
5.1. The Owner shall not be responsible for any cancellations, disruptions, or inconveniences due to unforeseen circumstances beyond their control, including but not limited to:
- Natural disasters, extreme weather conditions, or government regulations.
- Power outages, water supply interruptions, or other utility failures.
- Road closures, strikes, or transportation disruptions.
5.2. No refunds or compensation shall be provided for any disruptions caused by force majeure events or service interruptions beyond the Owner’s control.
6. GAS INSTALLATION SAFETY
6.1. The guesthouse is equipped with a gas-powered stove and gas geysers, which have been installed and certified by an accredited and approved installer in
compliance with all applicable South African legislation.
6.2. Guests are strictly prohibited from tampering with, adjusting, moving, or interfering with any part of the gas installation or cylinders.
6.3. If the Guest suspects a gas leak or malfunction, they must immediately report it to the Owner and refrain from using any gas appliances until the issue has been
assessed.
6.4. The Owner shall not be liable for any injuries or damages resulting from unauthorized tampering with the gas installation.
7. COMPREHENSIVE DISCLAIMER
7.1. ASSUMPTION OF RISK
The Guest acknowledges and accepts that staying at The 2 Marulas guesthouse, located in a wildlife conservancy, involves inherent risks, including but not limited to:
- Encounters with wild animals, including predators and venomous creatures.
- Risks associated with the natural environment, such as uneven terrain, exposure to extreme weather conditions, and potential fire hazards.
- Risks related to the use of facilities such as the swimming pool, braai area, and boma.
The Guest assumes all responsibility for their personal safety and the safety of all
members of their party.
7.2. LIMITATION OF LIABILITY
The Owner, its employees, agents, and affiliates shall not be held liable for:
- Any injury, illness, death, loss, or damage to persons or property occurring at the guesthouse.
- Any interruptions to electricity, water supply, or other utilities due to circumstances beyond the Owner’s control.
- Any force majeure events, including but not limited to natural disasters, extreme weather, or public health emergencies.
7.3. SWIMMING POOL SAFETY
- No lifeguard is on duty. Use of the splash pool is at the Guest’s own risk.
- Children must be supervised at all times.
- The Owner shall not be liable for any accidents, injuries, or fatalities occurring in or around the pool.
7.4. WILDLIFE AND SECURITY NOTICE
- Marloth Park is not fenced, and dangerous wildlife may enter the area.
- Guests are advised to remain vigilant, especially at night, and to avoid walking alone after dark.
- The Owner does not provide armed security services. Guests must exercise due caution.
8. SECURITY
8.1. The property is equipped with a monitored alarm system and CCTV cameras for enhanced safety and security.
8.2. The security system is connected to and monitored 24/7 by an appointed professional Security Firm.
8.3. A remote control for the alarm system is provided and is attached to the house keys.
8.4. Guests are required to activate the alarm system whenever they leave the property, even for short periods.
8.5. Guests are also advised to secure all doors and windows before leaving or retiring for the night.
8.6. The Owner shall not be held liable for any loss or damage resulting from the Guest’s failure to properly activate the alarm or secure the property.
9. CELLPHONE & INTERNET CONNECTIVITY
9.1. The property is situated in a bush conservancy, and cell phone signal may be intermittent or unavailable depending on location and service provider.
9.2. The Owner shall not be held responsible for poor or inconsistent cell phone coverage.
9.3. Complimentary Wi-Fi is provided for guest use.
9.4. The Wi-Fi password is displayed on the notice board in the kitchen.
9.5. Internet speed and stability may vary due to weather conditions and service provider limitations.
11. AIR CONDITIONER USAGE
11.1. The guesthouse is equipped with air conditioners. These air conditioners are connected to an independent prepaid electrical meter.
11.2. The meter is preloaded with units before arrival for your convenience.
11.3. If additional electricity is required, the Guest will bear the cost of topping up the meter. The same applies to the regular electricity meter.
11.4. Please ensure that all air conditioners are switched off when leaving the facility.
12. GOVERNING LAW
12.1. This Agreement shall be governed by and interpreted in accordance with the laws of South Africa.
12.2. Any disputes arising from this Agreement shall be resolved in the appropriate South African courts.
13. ACKNOWLEDGEMENT & AGREEMENT
By paying the deposit, the Guest acknowledges that they have read, understood, and agreed to all terms and conditions of this Rental Agreement, including the gas
installation safety clause and comprehensive disclaimer.
